Terms & Conditions

Please read these Terms and Conditions ("Terms") carefully before using the That Business Thing platform. By accessing or using our website at thatbusinessthing.co.za or any of our services, you agree to be bound by these Terms.

These Terms constitute a binding agreement between you and That Business Thing ("we", "us" or "our"), a South African business directory platform. If you do not agree to these Terms, you must not use our platform.

These Terms are governed by the laws of the Republic of South Africa, including the Electronic Communications and Transactions Act, 25 of 2002 (ECTA) and the Consumer Protection Act, 68 of 2008 (CPA).

1. Definitions

  • "Platform" means the That Business Thing website and any associated services operated by us at thatbusinessthing.co.za.
  • "User" means any person who accesses or uses the Platform, including browsers, registered account holders and business listers.
  • "Business Lister" means a User who submits or publishes a business listing on the Platform.
  • "Listing" means a business profile published on the Platform.
  • "Listing Plan" means a paid package selected by a Business Lister to publish their Listing.
  • "Content" means any text, images, descriptions, contact information or other material submitted to the Platform.
  • "Working Day" means any day other than a Saturday, Sunday or South African public holiday.

2. Eligibility and Account Registration

To access certain features, including listing a business, you must register for an account. By registering, you confirm that:

  • You are at least 18 years of age
  • The information you provide during registration is accurate, complete and current
  • You will keep your account information up to date
  • You are solely responsible for all activity that occurs under your account
  • You will not share your login credentials or allow others to access your account

We reserve the right to suspend or terminate any account we reasonably believe has been registered with false or misleading information, or that is being used in violation of these Terms.

3. Business Listings

3.1 Submitting a Listing

By submitting a Listing, you represent and warrant that:

  • You are the owner of, or are authorised to represent, the business being listed
  • All information in the Listing is accurate, truthful and not misleading
  • The Listing does not infringe any third-party intellectual property rights
  • The business and its activities are lawful under South African law
  • Any images submitted are owned by you or you have the necessary rights to use them

3.2 Our Right to Review and Remove

We reserve the right, at our sole discretion, to review, edit, decline or remove any Listing at any time if we reasonably believe it violates these Terms, is misleading, offensive or illegal, or is otherwise not in the best interests of the Platform or its Users.

3.3 Listing Accuracy

You are solely responsible for keeping your Listing accurate and up to date. That Business Thing does not independently verify the accuracy of any Content submitted by Business Listers and does not accept liability for inaccurate, incomplete or outdated information.

3.4 Listing Subscription Period

Each paid Listing Plan grants a fixed subscription period of 365 days from the date your Listing is first published on the Platform. The following rules apply to this subscription period:

  • The 365-day subscription period begins on the date your Listing is first approved and made live on the Platform.
  • If you choose to deactivate your Listing, the subscription period continues to count down. Deactivation hides your Listing from public search but does not pause, freeze or extend your subscription.
  • When you reactivate a deactivated Listing, your remaining subscription days are calculated from your original publication date. No days are added back for time spent deactivated.
  • Once your subscription period expires, your Listing will no longer be visible to the public. You will need to purchase a new Listing Plan to restore visibility.

By publishing a Listing, you acknowledge and accept that the subscription period runs continuously regardless of the activation status of your Listing.

4. Listing Plans and Payments

4.1 Fees

Publishing a business Listing requires payment of a fee as set out in the applicable Listing Plan. All prices are displayed in South African Rand (ZAR) and are inclusive of VAT where applicable.

4.2 Payment Processing

Payments are processed by our third-party payment providers, PayFast and Paystack. By completing a payment, you agree to their respective terms and conditions. We do not store your card or banking details.

4.3 Refund Policy

All Listing Plan fees are non-refundable once payment has been submitted. By completing payment, you acknowledge and agree that:

  • Listing fees are non-refundable regardless of whether the Listing has been published, deactivated, reactivated or removed by you.
  • No refund will be issued for unused days in the subscription period, including days where your Listing was deactivated.
  • If your Listing has not yet been published due to a technical error on our part, you may request a refund within 7 Working Days of payment by contacting us in writing.
  • If we remove your Listing due to a breach of these Terms by you, no refund will be issued.
  • Refund requests must be submitted in writing via our Contact page and will be assessed at our sole discretion, subject to the Consumer Protection Act, 68 of 2008.

4.4 Price Changes

We reserve the right to change Listing Plan prices at any time. Price changes will not affect Listing Plans already purchased.

5. Acceptable Use

You agree not to use the Platform to:

  • Submit false, misleading or fraudulent Listings or Content
  • Impersonate any person, business or entity
  • Upload Content that is defamatory, obscene, offensive, hateful or otherwise unlawful
  • Infringe any intellectual property rights of any third party
  • Spam, solicit or harass other Users
  • Attempt to gain unauthorised access to the Platform or any connected systems
  • Scrape, crawl or harvest data from the Platform without our prior written consent
  • Use the Platform for any unlawful purpose or in violation of any South African law
  • Interfere with or disrupt the integrity or performance of the Platform

Violations may result in immediate suspension or termination of your account.

6. Intellectual Property

All intellectual property rights in the Platform, including its design, logos, trademarks, software and underlying code, are owned by or licensed to That Business Thing. Nothing in these Terms grants you any right to use our intellectual property without our prior written consent.

By submitting Content to the Platform, you grant us a non-exclusive, royalty-free licence to display, reproduce and use that Content for the purposes of operating and promoting the Platform. You retain ownership of your Content.

If you believe any Content on the Platform infringes your intellectual property rights, please contact us via our Contact page.

7. Disclaimer of Warranties

The Platform is provided on an "as is" and "as available" basis. To the maximum extent permitted by South African law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement.

We do not warrant that:

  • The Platform will be uninterrupted or error-free at all times
  • Any Listing or Content on the Platform is accurate, complete or current
  • The Platform will meet your specific requirements

Nothing in these Terms limits any rights you may have under the Consumer Protection Act, 68 of 2008, which cannot be excluded or limited by contract.

8. Limitation of Liability

To the maximum extent permitted by law, That Business Thing and its team shall not be liable for any indirect, incidental, special, consequential or punitive damages, including loss of profits or data, arising out of or in connection with:

  • Your use of or inability to use the Platform
  • Any Listing or Content published on the Platform by Business Listers
  • Transactions or interactions between Users and businesses found on the Platform
  • Unauthorised access to or alteration of your data

Important: That Business Thing is a business directory platform. We do not represent, endorse or guarantee any business listed on the Platform. Any dealings you have with businesses found through our Platform are solely between you and that business.

9. Third-Party Links and Services

The Platform may contain links to third-party websites and services. These links are provided for your convenience only. We do not control and are not responsible for the content, privacy practices or terms of any third-party site. Accessing third-party sites is at your own risk.

10. Indemnity

You agree to indemnify and hold harmless That Business Thing and its team against any claims, losses, damages, liabilities, costs and expenses (including legal fees) arising out of or related to:

  • Your use of the Platform in violation of these Terms
  • Any Content you submit to the Platform
  • Your violation of any applicable South African law or regulation
  • Any misrepresentation made by you in connection with the Platform

11. Suspension and Termination

We may suspend or terminate your access to the Platform at any time, with or without notice, if:

  • You breach any provision of these Terms
  • We have reasonable grounds to suspect fraudulent or illegal activity on your account
  • We are required to do so by law or court order
  • We decide to discontinue the Platform or any part of it

You may request to close your account at any time via our Contact page. Termination does not affect any obligations that arose before it.

12. Consumer Protection Act Compliance

To the extent that the Consumer Protection Act, 68 of 2008 (CPA) applies, your rights under the CPA are fully protected. Nothing in these Terms limits or excludes any right or remedy you may have under the CPA, including your right to:

  • Fair and honest dealing
  • Full disclosure of information
  • Protection against misleading or deceptive representations
  • Fair, reasonable and just contract terms

If there is any conflict between these Terms and the CPA, the CPA shall prevail to the extent of that conflict.

13. ECTA Compliance

In terms of section 43 of the Electronic Communications and Transactions Act, 25 of 2002 (ECTA):

  • Platform operator: That Business Thing
  • Country of operation: Republic of South Africa
  • Contact: via our Contact page at thatbusinessthing.co.za/contact
  • All transactions concluded through the Platform are subject to South African law

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Republic of South Africa. Any dispute arising out of or in connection with these Terms shall be subject to the jurisdiction of the courts of South Africa.

Before initiating legal proceedings, you agree to first attempt to resolve the dispute by contacting us in writing via our Contact page. We will endeavour to respond within 10 Working Days.

15. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date at the top of this page. Your continued use of the Platform after changes are posted constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Platform.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and That Business Thing with respect to your use of the Platform.

If any provision of these Terms is found to be invalid or unenforceable, that provision will be severed and the remaining provisions will continue in full force and effect.
